Enforcing Removal Orders When a Person is Confirmed to be Outside of Canada

Description of the objective

Inadmissible persons may be issued a removal order. If an individual fails to confirm departure with the Canada Border Services Agency (CBSA), the removal order may remain unenforced. Currently, a removal order can only be enforced by an officer outside of Canada in very limited circumstances. Regulatory amendments to the Immigration and Refugee Protection Regulations are being considered to expand officer authority to enforce a removal order where the person concerned is confirmed to be outside of Canada.

Public consultation opportunities

Consultations will be held with various external stakeholders, including: the Canadian Bar Association; Canadian Association of Professional Immigration Consultants; Association québécoise des avocats et avocates en droit de l'immigration; the United Nations High Commissioner for Refugees; the Canadian Council for Refugees; and the National Association of Women and the Law. Consultations are expected to begin in the summer of 2017.

Other interested parties will be given a chance to participate in developing the regulations via pre-publication of the regulations in Part I of the Canada Gazette, and by announcement on the Consulting with Canadians website.
