Designation of Customs Controlled Areas

Subject to Part C of the attached Schedule, I hereby designate the places described in Part B of the attached Schedule to be “customs controlled areas” at the Calgary International Airport in Calgary, Alberta, pursuant to section 11.2 of the Customs Act for the purposes of sections 11.3 to 11.5, and 99.2 to 99.4 of the said Act.

This designation replaces the previous designation dated August 28, 2015. This designation will come into force on the date of signing.

Schedule – Customs Controlled Areas at the Calgary International Airport

Part A. Interpretation:

In this document, the following terms have the meanings assigned to them:

"Administration Office" (« bureau de l'administration »)
means the administration offices/buildings located in the public and/or domestic areas of the Airport, including head offices, regional offices, local head offices, training centres, service branches, and divisional offices, where professional or clerical duties are performed;
"Air and Ground Traffic Control Tower" (« tour de contrôle du trafic aérien et au sol »)
means all areas within the air and ground traffic control tower building, that require special access, located at the Airport;
"Aircraft Maintenance and Repair Hangar" («  hangar d'entretien et de réparation des avions »)
means a facility used for the maintenance and repair of aircraft;
"Airport" (« aéroport »)
means the Calgary International Airport in Calgary, Alberta;
"Bomb Tent" (« tente à bombes »)
means the building at the Airport where suspicious items are taken and disposed of;
"Bonded Warehouse" (« entrepôt de stockage »)
means a facility licensed and regulated by the CBSA and operated by the private sector where goods can be stored duty and tax free (generally for up to four years) until they are exported or are consumed domestically;
"Canadian Air Transport Security Authority (CATSA)" (« Administration canadienne de la sûreté du transport aérien (ACSTA)  »)
means the Crown Corporation charged with screening persons who access aircraft or restricted areas in the Airport, and their baggage;
"CATSA Area" (« zone ACSTA »)
means those areas in the Airport terminal buildings where CATSA screens air travellers and their baggage;
"CBSA" (« ASFC »)
means the Canada Border Services Agency;
"CBSA Primary Inspection Line Hall" (« salle de la ligne d'inspection primaire de l'ASFC »)
means those areas in the Airport terminal buildings where the CBSA conducts a primary inspection on travellers arriving in Canada from an international origin;
"CBSA Small Aircraft Centre" (« centre d'inspection des petits aéronefs de l'ASFC »)
means the building used by CBSA when they are inspecting travellers arriving from outside of Canada on small private or corporate aircraft;
"Check-In Area" (« zone d'enregistrement »)
means those areas in the Airport terminal buildings where passengers obtain their boarding passes and may deposit luggage to be stowed in airplane holds;
"Domestic Only Departure Lounge" (« aire de repos destinée seulement aux départs interieurs »)
means those areas of the Airport past CATSA screening that are used solely by domestic passengers;
"Domestic Carousel Area" (« zone des carrousels pour les arrivées nationales »)
means those areas in the Airport terminal buildings where domestic travellers collect their luggage after a flight;
"Field Electric Centre" (« centre de commande d'éclairage d'aéroport »)
means the building containing the equipment needed to control and supply back-up power to airfield lighting;
"Fire Station" (« poste d'incendie »)
means the building at the Airport where the emergency fire vehicles are stored, and where the emergency fire services are based;
"Fuel Station" (« poste d'avitaillement en carburant »)
means the area of the Airport set aside to store and dispense aircraft fuel;
"Inspection Services Building" (« bâtiment du service d'inspection »)
means the building used by Agriculture Canada to inspect live animals being shipped into and out of the airport;
"International Baggage Hall" (« salle des bagages internationaux »)
means those areas in the Airport terminal buildings where travellers wait for their luggage after an international flight;
"Maintenance Vehicle Garage" (« garage de véhicules d'entretien »)
means the building used to house and service airport maintenance vehicles;
"Parking Lot" (« parc de stationnement »)
means the places set aside by the Calgary Airport Authority for the parking needs of the public and of the employees of the Airport;
"PLH building" (« bâtiment PLH »)
means the building housing pump trucks and administrative offices used by PLH Aviation Services;
"Runway" (« piste »)
means the strip of level paved ground on which aircraft take off and land at the Airport;
"Secondary Examination Area" (« zone d'examen secondaire »)
means those areas in the Airport terminal buildings where the CBSA officers perform secondary examinations on travellers and their goods;
"Security Check Area" (« zone de contrôle de la sécurité »)
means those areas in the Airport terminal buildings where CATSA screens domestic employees and their belongings;
"Service Provider Buildings" (« bâtiments des fournisseurs de services  »)
means those buildings housing businesses providing services to the air transportation industry and its members;
"Sewer Dump Station" (« station d'élimination d'égout »)
means the building used by lav trucks to dump sewage waste from aircraft;
"Storage Eco-trailers" (« entrepôt des remorques-Eco »)
means the facility housing trailers used to haul waste and recycling from airside to the waste management facility;
"Sufferance Warehouse" (« entrepôt d'attente »)
means privately owned and operated facilities licensed by the CBSA for the control, short-term storage, transfer, delivery and examination of in-bond goods until they are released by the CBSA or exported from Canada;
"Taxiway" (« voie de circulation »)
means the strips of level paved ground used by airplanes, connecting runways with each other and with other parts of the Airport;
"Transborder Baggage Hall" (« salle des bagages transfrontaliers »)
means the secure building used for sorting/staging luggage belonging to passengers travelling to the United States;
"United States Pre-Clearance Area" (« zone de précontrôle des États-Unis »)
means the area of the Airport terminal building set aside for the use of the Government of the United States for its customs and immigration pre-clearance of passengers travelling to the United States, including both the primary and secondary inspection areas;
"Washrooms, Lunch, Locker and Shower Rooms for Employees" (« salles de toilettes, de restauration, vestiaires et salles de douche des employés »)
means those rooms within the Airport terminal buildings which are identified by the Calgary Airport Authority for individuals working at the Airport to eat and shower, and for lockers and washrooms to be used by these individuals.

Part B. Designation of Customs Controlled Area

Subject to the specific exclusions set out in Part C of this designation document, the following areas of the Calgary International Airport in Calgary, Alberta, are designated as Customs Controlled Areas within the meaning of the Customs Act:

All areas of the Airport where there is a likelihood that domestic workers or domestic origin travellers will come into contact with international travellers and/or international goods that have not been processed or released (as the case may be) by the CBSA, in addition to the CBSA Primary Inspection Line Hall, the International Baggage Hall, the Secondary Examination Area as well as public hallways and public stairways connecting these areas.

Part C. Exclusions

  1. Administration Offices;
  2. Air and Ground Traffic Control Tower;
  3. Aircraft Maintenance and Repair Hangars;
  4. Bomb Tent;
  5. Bonded Warehouses;
  6. CATSA Areas and Security Check Areas;
  7. CBSA Small Aircraft Centre;
  8. Check-In Areas;
  9. Domestic Only Departure Lounges;
  10. Domestic Carousel Areas;
  11. Inspection Services Building;
  12. Field Electric Centre;
  13. Fire Station;
  14. Fuel Station;
  15. Maintenance Vehicle Garages;
  16. Parking Lots;
  17. PLH Building;
  18. Runways;
  19. All or part of Service Provider Buildings not physically located in an area identified as a Customs Controlled Area;
  20. Sewer Dump Station;
  21. Storage Eco-trailers;
  22. Sufferance Warehouses;
  23. Taxiways;
  24. Transborder Baggage Hall;
  25. United States Pre-Clearance Areas; and
  26. Washrooms, Lunch, Locker and Shower Rooms for Employees.
