Guidelines
Non-compliance occurs when the customs broker fails to immediately provide the chief officer of customs with written notification of any changes in the individual(s) meeting the knowledge requirement in accordance with section 4 of the regulations, within their brokerage firm. Brokerage firms are required to have one individual who has Professional Status and acts as the “Qualified Officer” of the firm. These individuals must meet the knowledge requirements outlined in the Customs Brokers Licensing Regulations.
Prior to issuing an AMPS penalty, CBSA officers should verify the following information:
- Contact the chief officer of customs where the broker is licensed to confirm if the broker immediately provided written notification of any change in the individual(s) who meet the knowledge requirement in accordance with section 4 of the regulations within their firm.
- Contact Brokers Licensing Unit, in Headquarters, to confirm if the broker immediately provided the required notification of any change in individuals who meet the knowledge requirement in accordance with the regulations.
Apply a penalty per instance of non-notification per change of qualified person.
